Terms of Service

1. Agreement
These Terms of Service ("Terms") govern your access to and use of Forzza (the "Service"), operated by Lamacorn SASU, registered at 42 bis Avenue de Moutille, 33360 Cenac, France ("Forzza", "we", "us"). By creating an account or using the Service, you agree to be bound by these Terms.
2. The Service
Forzza is a software-as-a-service platform that helps B2B operators run AI- assisted outbound across LinkedIn and email. The Service detects real-time intent signals, drafts personalized messages, and sends them through your connected channels, with you as the final approver.
We do not guarantee specific results (reply rates, meetings booked, revenue). Outbound performance depends on your offer, your audience, and your approval decisions.
3. Account & Eligibility
You must be at least 18 years old and have legal capacity to enter into contracts to use the Service. You are responsible for keeping your account credentials confidential and for all activity under your account.
You agree to provide accurate information and to keep it up to date, particularly your billing details.
4. Billing & Subscriptions
Subscriptions are billed monthly in advance by Polar.sh, our Merchant of Record. Polar handles invoicing, payment processing, VAT, and sales tax compliance on our behalf.
By subscribing you authorize automatic monthly renewal until you cancel. You can cancel at any time from the billing portal — your subscription will remain active until the end of the current billing period.
Promotional or launch prices may apply for a limited time. We will give you at least 30 days' notice by email before any price increase. Continuing to use the Service after the change means you accept the new price.
5. Refunds
We offer a 7-day money-back guarantee on your first subscription. After that, charges already invoiced are non-refundable unless required by applicable consumer-protection law. Refund requests: hello@forzza.ai.
6. Acceptable Use
You agree NOT to use the Service to:
- Send unsolicited bulk messages (spam) or violate any applicable anti-spam law (CAN-SPAM, GDPR Article 6, French LCEN, etc.).
- Violate LinkedIn's, Gmail's, or any other third-party platform's terms of service. You are responsible for your own compliance with those platforms' rules — including rate limits, message content, and prohibited behaviors. Account suspension by LinkedIn or any third party is not our responsibility.
- Send harassing, deceptive, defamatory, or illegal content.
- Reverse-engineer, scrape, or attempt to extract source code from the Service.
- Use the Service to build a competing product.
- Share your account with third parties, except authorized team members.
We may suspend or terminate accounts that violate these rules, with or without prior notice depending on severity.
7. Your Content
You retain ownership of all content you upload, paste, or generate through the Service (ICP descriptions, voice samples, message drafts, prospect lists). You grant us a limited license to process that content solely to operate the Service for you.
8. AI-Generated Content
Forzza uses third-party AI models (Anthropic Claude, OpenAI GPT) to draft messages. AI output may be incorrect, biased, or inappropriate. You are responsible for reviewing every message before it is sent. The Service requires manual approval by default. We disclaim liability for content you choose to send.
9. Service Availability
We aim for high availability but do not guarantee uninterrupted service. Planned maintenance, third-party outages (Supabase, Vercel, Unipile, Polar, LinkedIn, Gmail), and force majeure events may cause downtime. We will not be liable for losses arising from such interruptions.
10. Privacy
Our handling of your personal data is described in our Privacy Policy, which forms part of these Terms.
11. Termination
You may cancel and delete your account at any time. We may terminate or suspend your account if you breach these Terms, if required by law, or if we cease offering the Service. On termination, your access ends; data is deleted per the schedule in our Privacy Policy.
12. Disclaimer of Warranties
The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. Some jurisdictions do not allow exclusion of implied warranties, in which case the above exclusion may not apply to you.
13. Limitation of Liability
To the maximum extent permitted by applicable law, our total aggregate liability for any claim arising out of or related to the Service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost data.
Nothing in these Terms limits liability for gross negligence, intentional misconduct, or any liability that cannot be excluded under applicable law (including French consumer-protection rights for consumers).
14. Indemnification
You agree to indemnify and hold harmless Forzza from any claim, loss, or damage (including reasonable legal fees) arising from your use of the Service in breach of these Terms, your violation of applicable law, or your infringement of third-party rights.
15. Changes to the Terms
We may update these Terms from time to time. Material changes will be communicated by email and a banner in the app, at least 30 days before they take effect. Continuing to use the Service after the effective date means you accept the updated Terms.
16. Governing Law & Jurisdiction
These Terms are governed by the laws of France. Any dispute arising out of or in connection with these Terms will be submitted to the exclusive jurisdiction of the competent courts of Bordeaux, France, except where French or EU consumer-protection rules grant consumers a different forum.
